The Appeals and Compliance Consultant provides legal analysis, management and expertise for the Department’s compliance objectives and daily activity within the DHS Health Care Integrity & Accountability (HCIA) Division. Responsibilities may include: • Serves as a legal and technical expert for HCIA activities, with a particular focus on health care appeals legal oversight and representation for the agency. This attorney will provide legal and technical support for various health care appeals. This position provides expertise in the preparation and defense of the agency's position in the federally and state-mandated Medicaid and MinnesotaCare administrative state fair hearing appeal responses for the fee-for-service delivery system, and support for and legal oversight of provider appeals. • The incumbent ensures consistent, accurate, and timely-responses to requests for health care-specific data, and works to support DHS HCA employees remain in compliance with federal and state statutes, case law, and federal and state court rules governing data practices. • Oversee and advise on legal process and policy for Medical Assistance (MA) and MinnesotaCare (MCRE) member overpayment activities, which occur at the county level. • Coordinate with the HCA directors and managers to develop legislative, rulemaking, and policy proposals, responses, documents, and supporting fiscal information to determine compliance, recommend actions or changes needed to achieve compliance if needed, and formulate changes in legislation or administrative rules to assist Administration activities.
Three (3) years specialized professional experience in working with the federal and state law, case law, and regulations governing MHCP eligibility, MA, MinnesotaCare, TPL, fee-for-service delivery system, managed care, or administrative appeals in Minnesota. Experience must demonstrate: • Knowledge and experience with legislative processes, document formats, and accepted procedures for introducing and supporting proposed legislation.
